By accessing or using PropFlowAI's services, including our website, AI assistant (Clara), SMS messaging, and phone communication features (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
PropFlowAI provides AI-powered operational intelligence and concierge-level service for real estate property managers. Our AI assistant, Clara, handles tenant communications including maintenance requests, scheduling, and general inquiries via SMS and phone.
3. SMS & Phone Messaging Terms
By using our messaging services, you acknowledge and agree that:
- Consent: By texting or calling our service number, you consent to receive SMS messages and phone calls from PropFlowAI related to your maintenance requests and property management communications.
- Message frequency: Message frequency varies based on your interactions and maintenance requests.
- Message and data rates: Standard message and data rates may apply depending on your mobile carrier plan.
- Opt-out: You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive a confirmation message and no further texts unless you re-initiate contact.
- Help: Reply HELP for assistance or contact us at support@propflowai.co.
- Supported carriers: Major US carriers are supported. Carrier delivery is not guaranteed.
4. User Responsibilities
- You agree to provide accurate information when communicating with our Service.
- You agree not to misuse the Service, including sending abusive, threatening, or fraudulent messages.
- You are responsible for maintaining the security of your account credentials if you have a dashboard account.
- You agree to report true emergencies (gas leaks, fires, flooding) directly to 911 and not rely solely on the AI assistant.
5. AI-Generated Content
Clara is an AI assistant. While we strive for accuracy, AI-generated responses may contain errors. Troubleshooting guidance is provided for informational purposes and should not replace professional advice for complex or safety-critical issues. Always prioritize your safety and contact emergency services when appropriate.
6. Intellectual Property
All content, features, and functionality of the Service (including but not limited to text, graphics, logos, and software) are owned by PropFlowAI and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
7. Limitation of Liability
To the maximum extent permitted by law, PropFlowAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount paid by you (or your property manager on your behalf) in the twelve months preceding the claim.
We are not liable for delays or failures in service delivery caused by carrier outages, network issues, or force majeure events.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated responses will be accurate in all cases.
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.
10. Changes to Terms
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will indicate material changes by updating the “Last Updated” date at the top of this page.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
